Can a Nation Built By Giants Survive the Disability Industrial Complex?

Vivek Ramaswamy got himself in some hot water a couple of weeks ago when he tweeted about American culture. He’s wrong on the big picture, but his comments about American workers hits a nerve… 

While the US Constitution and free market capitalism set the foundations for American prosperity, it took a rugged, passionate, free people to build it. From George Washington to George Washington Carver to millions of other Americans, the United States was carved out a continent of forests that seemed to go on forever, fertile plains, vast mountain ranges and scorching hot deserts.  Over time American frontiersmen, settlers and entrepreneurs forged a country that seemed to have all of God’s blessings in abundance.

Conditions were rarely easy for most Americans throughout most of our history. Coal miners spent 12 – 16 hour shifts in dangerous mines in which they sometimes couldn’t even stand up. Frontiersmen built a homestead and a farm out of a thick Appalachian forest while fighting brutal winters and a tenacious Indian population. Slaves toiled for years at backbreaking work during freezing winters and boiling summers. At the end of the 19th century over 50% of Americans still lived and worked as farmers, a far more dangerous job than most people understand. The industrial revolution brought sweatshops and drove a thirst for steel, trains and petroleum, industries that brought new dangers.

One sometimes has to marvel that the colonies survived long enough to coalesce and challenge the British for independence and then go on to grow and prosper (mostly) for over 200 years as it changed the world.

Were the Americans who carved a nation out of a continent somehow so different than Americans today? Were the Americans who crisscrossed a continent with railroads, telephone lines and highways so different than Americans today? Were the Americans who won two world wars and sent a man to the moon so different than Americans today? Were the Americans who invented the mechanical reaper, air conditioning, vulcanized rubber and the microchip so different than Americans today? Not based on DNA they weren’t. But that doesn’t mean they were the same. While the DNA of the American people today is no different than that of the people who invented the elevator or the light bulb, the American people writ large certainly appear to be.

Go back little more than one generation and it seems like Americans were something of another species. Compared to 2025, they appear to be relative supermen. In 1970 there were 79 million people working in the United States supporting 1.5 million workers on Disability Insurance (SSDI). That means that one person out of every 52 workers was on Disability… Fast forward 5 decades and it seems as if the country has turned on its side. By 2024 the number of Americans working had risen by 100% to 161 million people. During that same period however, workers receiving disability insurance skyrocketed up 380% to 7.2 million. Today, instead of one out of every 53 workers being on disability, it’s one in 22! That number is particularly interesting because the United States of 1970 was a far grittier place than the United States of 2025.

First off, the United States in 2025 is a much different workplace than the one that existed in 1970. In 1970 fully 25% of the American workforce worked in manufacturing while 50% worked in the service industry. Today, 8% of the American workforce works in manufacturing while over 70% of workers work in the service industry. Given that designing a website, taking an order at Chili’s or greeting a guest at Marriott is generally less dangerous than welding together various pieces of a Ford Ranger or operating a blast furnace at a US Steel plant, America should be a safer place to work. And indeed it is. The death rate for American workers in 1970 was 18 per every 100,000 workers. By 2023 that rate had dropped to 3.5, a decline of 80%.

But of course work is not the only place where one gets hurt. Today, virtually everywhere Americans go everything seems safer. Cars have seatbelts, antilock breaks and airbags. Houses have GFCI circuit breakers in bathrooms and kitchens and smoke detectors in almost every room. Lawn darts are but a distant memory and towns across the country require helmets for bicycle riding and virtually every appliance and medicine comes plastered with book length warning label. At the end of the day, America has become a far safer place to live and work than it has been at any time in its history.

But somehow in that much safer America, the total of people listed as disabled and receiving disability payments has skyrocketed:  The government spends more on disability than on food stamps and welfare combined.  American workers paid .5% of their paychecks for SSDI when it began 70 years ago, but in 2022 they paid 2%.  That means that $2 out of every $100 an American worker earns goes to support someone not working.

How is that even possible? Have Americans become weaklings, unable to stay healthy? Has some unknown affliction made us incapable of working? No. There is an affliction, but it’s not biological. It’s called the nanny state. From judges who rubberstamp virtually every claim they ever see to a quarter of applicants suffering from musculoskeletal injuries – which conveniently enough cannot be detected by doctors – to outright fraud (more)(more)(more) and states seeking to shift costs to the federal government, SSDI is a symbol of much of what is wrong in America today, where in 2022 fully 4.5% of working age Americans were on disability. The worst thing about this dysfunctional program is that the fraud keeps people who are in real need of help waiting in line, sometimes to die.

When government decides to play the role of caretaker and redistribute wealth from workers to everyone else, it should come as no surprise that many people will choose to jump from the working pool to the everyone else pool. For more proof just look at the food stamp program over the same 50 year period. While the population has increased by about 75% since 1970, workers by 100% and disability by 380%, food stamp recipients grew by over 1,000%!

The economics of the welfare state, including the “disability industrial complex” cannot be sustained. If the record of the last 50 years were to be repeated over the next 50, in 2075 the country would have 320 million workers supporting almost 30 million people on disability and 450 million people on food stamps. Those numbers are simply unsustainable, particularly if the goal is to Make America Great Again.

American workers and entrepreneurs have together created the greatest wealth and prosperity the world has ever seen, but eventually the numbers stop working.  The thing I think Ramaswamy misses is that it was inevitable that the spirit that helped forge a nation out of a continent and dot it with jewels like the Empire State Building, the Hoover Dam and the Golden Gate Bridge would reemerge and shrug. That’s what happened in November. For it to make any difference however, the nanny state will have to be eviscerated, and not just the regulatory part of it. 
The redistribution apparatus will have to be dismantled too, and the disability industrial complex is a good place to start.

Ronald Reagan Showed What Honest Elections Bring - Democrats Knew They Were In Trouble

I would argue that aside from 1860, 1984 was the most important election in American history thus far. Ronald Reagan was running against Jimmy Carter’s vice president Walter Mondale.  America, at the end of the Carter administration was beleaguered, both emotionally and economically. The Iranian Hostage countdown had Americans glued to their television sets and the combination of double digit inflation and interest rates would knock them for a loop through the first couple of Reagan’s years.

But then Reagan’s policies began to kick in. Lower taxes, less regulation and increased energy output put the country on a path that would generate GDP growth of 7.2% in 1984, a number not seen since 1951 and one we’ve not seen since. At the same time, Reagan’s rebuilding of the American military and his unwavering support of freedom in the face of Communism made Americans feel confident on the world stage for the first time in two decades.

All of this translated into something unprecedented in American history.

In 1788 and 1792 George Washington won both elections by unanimous Electoral College votes.  Following that, in 1820 James Monroe won every state and every Elector except for one.

From that point forward no president ever won every state or the Electoral College by a unanimous vote.  A couple came close, including FDR winning all states but two in 1936 and Nixon winning 49 states in 1972, losing one state, Massachusetts, and DC. 

In 1984 Reagan equaled Nixon’s feat and won every single state other than one, Minnesota, Mondale’s home state, and DC. So, since 1968 the GOP had triumphed in 4 out of 5 elections and in only 12 years had twice won with 49 of 50 states. For Democrats, that could not stand…

They knew that if they didn’t do something, they’d find themselves in a wilderness like they’d never seen before.  And do something they did.  The first thing they did was to dupe Ronald Reagan into signing the 1986 Immigration and Border Control Act into law.  In “exchange” for making 2.7 million illegals citizens, the Democrats (assisted by worthless Republicans led by the feckless Alan Simpson) promised to build a wall on the southern border. 

The Democrats got their 3 million new voters, but Reagan and America didn’t get their wall.  As a result of that, today we have upwards of 30 million illegals in the country and Democrats who want to let them vote and or  make them citizens! And it worked. In 1992 California, Illinois, Massachusetts and other immigrant heavy states turned blue for the first time since 1964 and have never turned back.  

But lying to Reagan wasn’t the only thing Democrats did. Always keeping their eyes on the long game, they recognized that having millions of new illegals doesn’t help them a lot if they can’t vote. (Although they skew Congressional apportionment, typically towards Democrats.)  So they set in place a plan that would eventually allow them to register to vote.  That plan was the 1993 Motor Voter Act, signed by Bill Clinton and ostensibly sold as a law make it easier to register “underrepresented” voters. 

At the time illegals weren’t allowed to get licenses in the United States, but again, Democrats were playing the long game and today 19 states and the District of Columbia do provide them.  And to no one’s surprise, almost every one of those states is blue.  Together these states represent 230 of the 270 Electoral College votes necessary to win the White House and eventually the law morphed into a vehicle facilitating immigrants and illegals registering to vote.   

But like any good insurgency, the Democrats had multiple areas of attack. Beyond flooding the country with new Democrats, they were doing other things as well.

One of those was extending the voting window. This one would seem like it’s bipartisan as it applies equally to everyone.  But not so much. There’s a reason most negotiators will tell you to let the other person make the first offer in a negotiation.  Aside from the power dynamic, it gives you insight into what cards your opponent is holding.  The same holds true here.  It’s much easier to understand how many votes you need to manufacture if you know in advance what the numbers against you are.  That’s exactly what we saw in 2020 when as the 3rd of November closed out Donald Trump was ahead in a handful of states that flipped to Joe Biden by just enough votes to win. Georgia with 4.9 million votes was decided by 11,800 votes or less than .2% of the total votes.  Arizona, with 3.3 million votes was decided by 10,400, or .3% of the total.  Similarly Wisconsin, with 3.2 million votes cast was decided by 20,000 votes, or .6%.  Together those three states represent 37 Electoral College votes, which are exactly the number necessary to flip the election from Trump to Biden. Then of course there’s machine voting. Although the two parties have gone back and forth over this for years, the reality is, and always has been that they are simply computers which are easily hackable.  Despite years of Democrats claiming machine voting was unsafe, immediately after Trump “lost” we were told 2020 was the most secure election ever, this despite overwhelming proof that Dominion and other machines are not, in fact, even remotely secure.


The Holy Grail of Democrat cheating is mail in voting.  Like computer voting, mail in voting provides endless opportunities for cheating, such as retirement home and homeless vote harvesting, as well as eliminating signature verification. Indeed, in 2020 Democrats used the COVID hysteria to change voting laws and balloon mail in voting across the country so that by election day over 65 million people or 1/3 of the electorate had already voted via mail.

And even for those who actually turn up to vote in person, Democrats make it easy to cheat.  Democrats have fought voter ID laws for decades. If a picture is worth a thousand words a picture of a Voter ID map is worth countless elections. As one can see, almost every Democrat state has no Voter ID while almost every solidly GOP state requires photo ID. This, despite the fact that 80% of Americans support Voter ID laws. (In Europe, which Democrats aspire to emulate, 46 out of 47 countries require photo ID to vote.)

There’s more of course, from fighting efforts to clean up voter rolls to using lawfare to harm opponents, to using government agencies to quash free speech, but the bottom line is, Democrats cheat every opportunity they get, because they simply can’t win otherwise.

As America careens towards the most consequential election in our history, one that presents a stark choice between an imperfect but competent patriot and a Communist imbecile in Democrat clothing, Republicans need to understand what they are up against. A Democrat party that will sacrifice everything, from children to communities to the lives of citizens in their quest for power will eliminate the Constitution and the Republic without hesitation. They’ve told us as much.  We should believe them and act accordingly. Now is not the time for timidity.  As IKE said:  "History does not long entrust the care of freedom to the weak or the timid."

Following a Donald Trump Forged in a Crucible of White Hot Fire

 I first started writing a blog in 2009, after Barack Obama’s election. My first post, America’s Original Sin, addressed the then-nascent movement to disparage and denigrate America because the Founding Fathers didn’t have the foresight in 1787 to write a constitution that would dovetail with the mores of 21st-century snowflakes.

The title of my blog, Imperfect America, is followed by a quote attributed to the French philosopher, Voltaire: “Perfect is the enemy of the good.” Our nation is a billboard-sized testament to that adage. Rarely have we seen perfect, but we frequently see good. And that’s the problem with leftists… They want to sacrifice good for the fiction of perfection.

While today it’s all the rage to dwell on America’s failures, it’s far less celebrated to talk about her triumphs. Although the left has been demonizing America since the sixties, it was after Bush won in 2000 that this tactic started to stick. The cancer of hate really took off once Obama became president. On college campuses, in elementary schools, on nightly newscasts, and in papers across the country, we were incessantly told that America was racist, sexist, homophobic and destroying the environment.

It was into this miasma that Donald Trump marched when he announced he was running for president. He saw the leftist cancer destroying the very foundations of freedom, opportunity, and prosperity while undermining America’s core civilization and setting the country up for a devastating collapse. And he willingly stepped into the breach to stop it.

The problem, however, was that rather than running as a Democrat, where all solutions come from an omnipotent central government, he was running as a Republican who sought to reduce government control and return power to Americans.

That was a bridge too far. From the second he announced, Trump found himself enduring a withering barrage of vitriol and venom unseen in American politics. The abuse came from Democrats, the media, social media and academia as well as the GOP establishment. What Trump endured was relentless. Yet somehow, he won.

In the wee hours of November 9, 2016, it became clear that Trump would become the next president of the United States. It also became clear the Democrats were not going to take it lying down.

The Russia Collusion hoax started a drumbeat that would bedevil the president for the next four years, even after it was shown to be a Clinton crafted fiction the mainstream media parroted. Indeed, the New York Times and the Washington Post would win Pulitzer Prizes for their “reporting” on the fake story, and no, not because they exposed the lie but, instead, because of their vociferous and eloquent participation in it.

During his presidency Donald Trump endured extraordinary abuse and treachery, driven by the media and the Democrat party. The irony of the media’s hatred for Trump was that channels like CNN and MSNBC virtually owed their rescue from irrelevance to the Trump presidency, while newspapers slowed their decades-long declines with pages of anti-Trump rhetoric.

As bad as the media abuse was, it was nothing compared to the treachery of the apparatchiks in the government. When Trump tried to build his promised wall, he was blocked at every step. His efforts to make Bureau of Land Management employees live closer to the lands they regulated were pilloried for making the agency “less diverse.” Lt. Col Alexander Vindman, the NSC’s Ukraine expert, launched an impeachment when he lied about Trump trying to coerce Ukraine into investigating the Bidens.

And if all that wasn’t bad enough, during the Covid “pandemic,” possibly the most economically destructive self-inflicted wound in human history, the two government-employed doctors Trump looked to for guidance lied to Trump and the country. Finally, in perhaps the greatest treachery of all, we learned that members of America’s law enforcement and intelligence agencies were actively working to undermine Trump in the election.

Worse, this orgy of Trump-directed destruction wasn’t just in Washington. The 2020 riots cost billions of dollars in damage, and brought chaos and bloodshed to cities across the country, all the while being spurred and supported by Democrats single-mindedly focused on defeating Donald Trump.

These attacks were relentless, every single hour of every single day and came from inside and outside of government. Yet somehow Trump managed to run the government well and campaign like the Energizer Bunny. In the end, it took a literal coup d’état to oust him from office.

And now he’s back—and the mainstream media, Democrats, the GOP establishment, bloggers, and erstwhile fans all insist that we’re supposed to abandon him.

Aside from the fact that the Democrats will demonize as a Nazi, racist, homophobe anyone who carries the GOP flag, the reality is that Donald Trump is a fighter for America unlike any president we’ve ever had. No one has ever had to endure the level of vitriol or withstand the relentless phalanx of persecution from every corner as Trump has.

And here’s the thing…he didn’t need to. Trump was a billionaire already. Trump was already feted by politicians and media around the world. He already had a beautiful family, spectacular homes, and his own plane! No politicians in American history had more to lose when they decided to fight for the American people than Trump did. Usually, politicians go to Washington as middle class and leave millionaires. Trump, however, had literally billions of dollars to lose, but he took on the Swamp anyway.

Now, after enduring seven years of abuse for his defense of American freedom, prosperity and farmers and truckers and little guys of all shapes and sizes, he’s once again stepping up to do battle.

You may not like Donald Trump, and there’s much to not like. He’s arrogant, he’s petty, he’s defensive, and he can be cruel. (Those attributes can just as much be applied to Barack Obama.)

Unlike Obama however, Trump doesn’t try and pretend he’s something he’s not. He’s a crude, brash New Yorker who speaks his mind and gets things done. He knows how to fix things and wants to fix America with strong borders, energy independence, limited government, a robust economy, and individual liberty… All of the things the Swamp fought him on and the very things Joe Biden has undermined.

Donald Trump circa 2022 is still imperfect, but he’s been forged in a crucible of white-hot fire and has emerged even more focused than before on making America great. So, yes, while there may be brilliant lights on the horizon, I think I’ll take a pass and stick with the guy who got out of his Bentley and ran through a gauntlet of machine gun fire into the burning mess of Democrat America in order to save the eagle stuck inside.

Trump may tell off-color jokes and may not always be the best judge of character, but he can take the heat, and his North Star has always been prosperity and security for the American people. Given the literal evil the Democrats are seeking to impose on America, I’ll happily follow him into the fire.

Five For Freedom - A Contract With America For The 21st Century

  America’s in a civil war.  Not a cocktail party war like Vietnam or Afghanistan where Americans stand around and talk about it but relatively few are personally impacted.  No, this a WWII level existential threat war where the difference between victory and defeat is literally freedom or tyranny.  One need look no farther than what Adolph Trudeau is doing in Canada right now to understand what the future holds. 

This war has been simmering for decades and most Americans didn’t even notice.  Now it’s obvious. Virtually every element of traditional American culture is being destroyed.  The left has decided that the United States is a plague on humanity and must be eliminated.

In this case the “left” consists of government, media, big tech, big business, and academia, among others.

Here’s a short list of their targets…    

Turning schools into leftist Indoctrination centers

Government control of your neighborhood

Open borders

Money / Driver’s licenses / Voting for illegals

Legalizing crime / No bail  

Encouraging Empowering homelessness

2nd Amendment

Censorship

Gender reimagining

Control over your body

Free exercise of religion

Peaceably assemble

Men having babies

Banking

Climate Change

CRT

Government spying on citizens

Girl’s sports

And of course, most problematic of all is their successful coup d'état.

With that and more, do we still live in a free country?  Obviously not.

Which brings us back to war.  Ask yourself, if someone declared war on America, what more might they do in victory? Other than killing you or turning you into slaves, what more is there?

Some argue we’re not in a war, citing polls that show a majority of Americans don’t like those leftist positions.  That’s accurate, but it doesn’t matter. The majority doesn’t count. The people who “count”, the opinion makers, those in academia, media, high tech, etc are the hardcore leftists behind all of this, and as we all know, the squeaky wheel gets the oil.

Americans have traditionally been ambivalent about government. For most politics was something to be endured every four years and after the election life got back to normal.

But no longer.  If you were a Teddy Roosevelt partisan or a fan of Truman or IKE, whether your guy won or lost didn’t matter tremendously to the average American.  Maybe your taxes would go up or down a bit or maybe the price of gasoline or chicken might change a bit, but that was it for most people, because government, particularly the federal government had little impact on their everyday lives.

Today not so much. In America of 2022 the federal government impacts almost every aspect of American lives, daily.  The price of gas, grades of meat, rate of pay at work, MPG for your car, Epi-Pens, not to mention vaccine mandates, gun regulations and shipping illegal immigrants to your neighborhood.  But it’s not just the federal government.  It’s state and local government as well.  From inane licensing requirements for hairdressers, bartenders and Uber drivers to union-centric dysfunctional schools and gun laws that outlaw the 2nd Amendment in all but name, the fists of the federal fit perfectly into the state and local regulatory gloves, together strangling American freedom. 

But government’s not the only front in this war. There’s culture too.  From social media – the 21st century’s public square – to mass media to academia and big business, the left dominates.  Not just dominates as in winning, but dominate as in ruling over everyone else.  Live and let live is not an axiom the left recognizes or exercises.  No, the left demands fealty or will crush you.  They’ll destroy your business, get you fired or banned from social media, take your kids away, kick you out of college and anything else they can think of.

Today we’re seeing the government leviathan becoming even more powerful as it assimilates with the leftist borg.  We saw it for four years as the FBI worked side by side with the media to tarnish Donald Trump’s name and destroy his presidency. Now, Joe Biden has encouraged the silencing of “misinformation”. 

At the same time the federal government has essentially established a gulag to house political prisoners who participated in the “insurrection” despite many being invited into the building by the police, some never entering the building at all and most having been involved in no violence whatsoever.  Some of these “terrorists” have been sitting, without charges or bail, in jails for over a year.  That treatment stands in stark contrast to the treatment of those who participated in the violent and deadly BLM / Antifa riots of the summer of 2020, most of whom were bailed out in the unlikely event they ended up in custody in the first place. 

All of this points to a fracture of America. Observations about “majorities” give one hope, but the reality is that unless the “majority” who reject leftism react, it won’t matter because, as we’re seeing in real time in Canada, the wall between freedom and fascism is fragile, and once it’s breached it’s likely game over.       

If the Republic is to survive it will be up to that “majority” to do something to arrest the slide into tyranny.  The GOP needs to take a page from Newt Gingrich and give them something to focus on, to talk about, and most importantly, vote on. The Contract with America was pivotal in nationalizing the election, and that’s exactly what we need now, a message that patriots can rally around.

The fronts upon which the left is attacking are too numerous to defend against simultaneously.  The battle lines need to be streamlined just as the Contract did.  As such, here are Five for Freedom… five common sense items that every GOP candidate or official must agree with if they want to win.  If they refuse on any one of them, they should be primaried or defeated in favor of someone who does support them.

1.  The 2020 election was fraudulent and such fraud cannot be allowed to occur again.

2.  Covid mandates are unconstitutional and must stop.

3.  The #1 job of the federal government will be to seal the southern border.

4.  The United States must be energy independent.

5.  CRT has no place in American schools.

If any candidate running on the GOP ticket can’t support these five positions, they have no place in the GOP. The threats to liberty are too numerous, the threats to the Constitution too grave to elect someone who will waffle on these basic principles.

If there is indeed a majority of Americans who are interested in saving the Republic, they have to have something to rally around.  Thus far the GOP has done an atrocious job of focusing America’s attention.  They need to do that now and Five for Freedom is the tool to do just that.  It’s likely it will have to happen over the objections of establishment Republicans like McConnell, McCarthy and Ronna McDaniel, but so be it.  At the end of the day you’re either on the side of freedom or not.  As the last two years have demonstrated, liberty is fragile and without citizens willing to stand up for it, it vanishes. This is the time, this is the place and Five for Freedom is the weapon with which patriots can vanquish the borg of woke leftism that has been seeking to assimilate America for decades.  The only question is, does the GOP have the courage to wield it?

We the People... Address 2020 Now, Otherwise Our Constitution is Just Another Crumbling Piece of Paper

A solid majority of Americans know that the 2020 election was fraudulent. That’s a big problem for a country with a representative government, one in which the leaders are supposed to represent the will of the people. We’re a nation of laws ostensibly flowing from a Constitution that sets out explicit limitations on the federal government’s powers and protects a variety of citizens’ rights upon which said government cannot infringe. To the degree that a significant majority of citizens feel that the leader of this government was not constitutionally elected, that’s a problem.

For all its importance, our Constitution is nothing more than a piece of paper. It doesn’t make laws. It doesn’t have an army. It’s not the police. It’s just words on paper. It functions because Americans have confidence in its words as the foundation for the laws of our country and the guideposts governing the actions of those who actually control the army and the police and write the laws.

When that confidence is shaken, society’s foundation is shaken. While the fraudulent election of 2020 is not the first example of that shaken confidence in government, it’s easily the most important. From the economic upheavals wrought by the Industrial Revolution to widespread hopelessness during the Depression to the perceived fecklessness during the Vietnam War and economic malaise of the 60s and 70s, confidence in government has been shaken before but never before has the government’s legitimacy been in widespread doubt.

That changed with the 2020 election. Americans watched as the fraud played out in real-time, right in front of them. With violent riots in the streets that went unrestrained in the months leading up to the election, with courts inexplicably ignoring countless unconstitutional changes to voting laws, and with the media and social media censoring true stories that harmed Democrat chances, it started to seem as if the scales were tipped to one side. On election night and during the following weeks it became clear that this was indeed the case.

When almost 60% of the American people feel as if the man who is both the leader of the country and the head of the federal government is illegitimate, what are they supposed to do?

There’s nothing to be done we’re told… Not true. The election can be overturned. Not that I imagine there’s sufficient internal fortitude among Republicans to do so but, ideally, they should make the attempt. But how?

The Constitution doesn’t address anything remotely close to reversing a fraudulently achieved election. That’s true, but then it also says nothing about the right to abortion, the government providing welfare payments to citizens (or non-citizens), government control of healthcare, the imposition of CAFÉ standards, or collective bargaining rules. Indeed, there is much that goes on in government that is not in the Constitution. In 1803, Thomas Jefferson worried that the Constitution did not give him the power to make the Louisiana Purchase, but today all or part of 15 states exist because of it.

Like John Marshall’s judicial review doctrine, which you won’t find anywhere in the Constitution, things don’t exist until they do. In this case, in states where fraud is proven or where voting laws were enacted unconstitutionally, the legislatures should withdraw their Electoral College votes and recast them based on accurate and lawful counting of the votes.

It’s true there’s no existing Constitutional mechanism to facilitate that remedy, and the likelihood of a Democrat-controlled Congress doing anything to further it is less likely than a healthy college student dying of COVID, but that doesn’t mean it shouldn’t be done. It should, and it should be driven by those states where fraud so clearly occurred and tipped the election; essentially ground zero for the coup: Georgia, Arizona, Wisconsin, Michigan, and Pennsylvania, all five of which have nominally GOP legislatures.

Many will say that this is extra-constitutional, and that may indeed be true. But what is beyond debate is the fact that the 2020 election itself was extra-constitutional. The Constitution states that elections are to be run according to rules set by state legislatures. That didn’t happen across the country.

If one is going to have an election run beyond the explicit parameters of the Constitution, I’d prefer to have it hew as close as possible to what the document actually says, rather than what some hack Secretaries of State or uber partisan jurists say that it is. Our Founding Fathers gave the power to craft election rules to state legislatures and that is where it should reside.

Now, assuming that the legislatures of these five states—and others as they choose—take seriously their duty to address the fraud of the 2020 election, Congress will have a decision to make. Congress can either engage with the states to address the issue or simply ignore them. Currently, there is zero chance of action, but after the 2022 midterms Congress will likely look different and the opportunity to address the issue can be revisited.  Although with spineless weasels Mitch McConnell and Kevin McCarthy leading the GOP in Congress the outcome would likely be exactly the same as one led by Nancy Pelosi and Chuck Schumer.  Nonetheless…

This may sound like spinning wheels, but it’s not. On the contrary, affirmatively excising the demons of the 2020 election should force all politicians or candidates to make their positions known. They either admit that the 2020 election was fraudulent and are willing to do something about it or they don’t, won’t, and should be primaried if GOP or defeated if Democrat. There can be no in between. If the flaws of 2020 are not admitted and addressed, then 2024 is gone before the campaign even begins, and almost every American understands that.

Why this matters is simple: The nation is changing, rapidly and not in a good or constitutional way. From vaccine mandates to CRT seemingly everywhere to locales providing COVID medicines based on race to transgender men competing in women’s sports to mayors and governors essentially giving their communities over to the homeless and violent criminals, America in 2022 is not one someone from even a decade ago would recognize. It’s changing, rapidly, and in most cases against the wishes of large majorities of the American population.

Importantly, though, we’re not a democracy, and the Constitution is built to rein in the passions of the majorities. It’s not a suicide pact. American citizens with confidence in their election system are willing to wait for the next election cycle to direct a change of course. Those same citizens, however, if they feel that the system is fraudulent and if they know the game is rigged against them, will find alternative means to stop the evisceration of the nation so many of them cherish. When the majority—and a growing majority, at that—of a population believe their leaders are illegitimate, bad things tend to happen.

Illegitimate regimes can stay in power for decades, but only with an army of stormtroopers and Gestapo to suppress a cowed population. The United States is not Germany in the early 1930s nor China today and Americans are not yet cowed. Indeed, they have 1st Amendment, a 2nd Amendment and a 250-year-old legacy of freedom most are wont to give up. This Democrat fascism will eventually come to an end. The question is how. The ideal solution is to be found at a ballot box, with all Americans confident their votes will be counted fairly. Let’s hope our leaders can find the courage to lead us down that path.

What Now - Part 2: Solution to Fraud? Pact of Secession

Earlier in the week I asked the question:  What if Proof of 2020 Presidential Election Fraud Develops? In it I mentioned a number of remedies that have been widely talked about from impeachment to a Pentagon coup to rioting in the streets.

None of those is an ideal solution. Indeed, the first wouldn’t correct the problem, the second would turn the United States into a third world banana republic and the last would bring about a modern version of the bloody chaos that characterized post revolutionary France.  

No, an ideal solution would reverse the inauguration of Joe Biden and inaugurate Donald Trump as the rightful president and do so while maintaining our Constitutional Republic.

As such, there is another option that could theoretically do that, and thanks to TV shows from Perry Mason to Law & Order it’s based on concepts most Americans are familiar with: “fraud vitiates everything” and “fruit of the poison tree”.  The former, based on the Supreme Court ruling UNITED STATES v. THROCKMORTON (98 US 61 – Supreme Court 1878); states that “There is no question of the general doctrine that fraud vitiates the most solemn contracts, documents, and even judgments.” That essentially means that in contracts – and an election is nothing if not a contract – fraud makes them invalid. Everyone knows if you sign a contract based on fraudulent information, that contract is invalid.  Further, from that comes “void ab initio” which means that fraud from the beginning taints everything resulting from it.  No doubt most of us have heard a TV lawyer seeking to throw out evidence against their client because the search itself or the information upon which the warrant was based, was fraudulent.  It’s called the doctrine of “Fruit of a poison tree” from NARDONE V. UNITED STATES, (308 U.S. 338 – Supreme Court 1939) which states that if a tree is poisonous, so too is its fruit. (H/T to Andrea Widburg, Donna Palen and Al Simon)

All of this means that once the fraud is demonstrated, the election is invalid; Joe Biden is legally not president and every action of the Biden administration has undertaken is void as if it never happened.  That of course has never been done in a presidential election but it’s occurred a handful of times in lower elections.  The fly in the ointment of course is that all of this it requires a court, and eventually the Supreme Court to rule that the election was indeed fraudulent.  Given the Supreme Court’s general (but very selective) reluctance to wade into political areas – particularly highly volatile ones – and this particular Court’s demonstrated cowardice, it’s unlikely that they would even consider the matter.

Which I think, leaves us with this:  If the Constitution provides no specific remedy to the bastardization of the Constitution itself, something new must be done.  As the Founding Fathers did in 1776, it may be necessary to rewrite the playbook. And that rewritten playbook, while not a new Declaration of Independence, is a tentative Pact of Secession. This pact would be among the states whose rightful votes should have gone to Donald Trump. These states should make it clear that the rights of their citizens to a Constitutional federal government have been infringed upon and if Congress does not remedy the situation they will, in unison, secede.

This Pact would not literally be secession… it would be the announcement of a proposed action that Congress would have the opportunity to avoid by rectifying the demonstrated Constitutional deficits of the 2020 election.  The reality is there is no blueprint for rectifying those deficits, but that is because Congress, the states and the Supreme Court allowed an unconstitutional inauguration to occur in the first place.  Nonetheless, the theft of the highest office in the land simply cannot stand.  As New York, California and a variety of blue states are seeing play out in their streets today, if you allow thieves to steal with impunity, if you allow thugs to harass and assault with impunity, you get more of each. The same holds true with the fraud of an election and the usurping of the apparatus of government and the coercive powers that come with it. If this theft is allowed to stand then no American can go forward with confidence in the nation’s elections and the system based on them.  Once again, the Constitution is nothing more than a piece of paper. It is the citizens’ loyalty to that Constitution and the system built upon it that make it work. The proof of that can be seen in the fact that the old Soviet Union, Cuba, China and most other dictatorships regularly have constitutions that promise freedoms and rights to their citizens that are rarely actually respected. Words on a paper mean nothing if the government is not bound by them and the citizens have no confidence in them. 

This is, as the British might say, a bloody mess. Indeed the last time secession played a pivotal role in American history that’s exactly what we got.  This however does not have to be that. Spurred by a Pact of Secession, Congress will have an opportunity, in concert with the states themselves, to address the demonstrated fraud and rectify the deficit of the election of 2020 in a cool, logical and peaceful manner.  But they need to understand that once the fire from the smoke of November 4th is demonstrated, the American people will not sit idly by and watch their Constitution shredded.  Too many have paid too high a price so that Americans could live under the umbrella of liberty it provides to allow such a transgression to prevail.

What Now - Part 1: What if We Find The Fire From the Smoke of Election Fraud?

If the last month has taught us anything, today’s conspiracy theory could easily be tomorrow’s commonsense truth. The speed at which the Wuhan Lab theory as the source of the Covid virus went from “thoroughly debunked” to “Viable” and “Probable” in the media was extraordinary. Indeed, the media scorned the possible source of the most economically destructive virus in history – one that is credited with killing 3 million people – because they didn’t like the then-President of the United States!

Despite the fact that the lab in Wuhan was one of the only places on earth where scientists were studying such viruses, that 3 Wuhan employees went to the hospital in November 2019 with what turned out to be Covid symptoms, that the NIH had actually been funding “gain of function” research in Wuhan focusing specifically on the transmission of such viruses to humans… we were told the Wuhan “China virus” theory was a racist conspiracy theory!

As much damage as Covid did – and far worse, the “lockdowns” used to inflict COVID's damage – that’s nothing compared to the damage another “conspiracy” has done and will do. That, of course, is the “thoroughly debunked” notion that the election of 2020 was stolen, and that Joe Biden is in the Oval Office today because of election fraud. But of course that’s just some tin hat conspiracy theory. We’ve been told that “There’s no evidence of election fraud” and Trump “Lost Nearly 60 Election Fights In Court.” The latter of course is fiction.

Given that we heard similar things for the last year about the origins of Covid, the question is, what happens when proof unequivocally demonstrates that the election was indeed stolen?

The smoke for that conclusion has been around since the wee hours of November 4thThe stopped counting in key states on election nightMark Zuckerberg’s wholesale purchase of the voting apparatus in key states and countiesThe unconstitutional changes to voting laws that crisscrossed the country… many empowered by the politicization of Covid... And then of course there is the TIME magazine piece that laid out in black and white the “inside story of the conspiracy to save the 2020 election”, chronicling widespread coordination of everyone from the Democrat party, Silicon Valley, BLM, unions, the Chamber of Commerce and various other players to get rid of Donald Trump.

All that has been missing has been the CSI level proof of the fire itself. Of course, given the depth and breadth of the Swamp, it may never come to light. But then it might. Currently in Arizona and Wisconsin audits are being done of the 2020 election.

So let’s imagine that somehow, integrity rules the day, and both states under audit produce rock-solid proof that the election in their states was stolen; what then? Technically, nothing. Arizona had 11 electoral votes and Wisconsin had 10. Together they represent 21 electoral votes and Joe Biden was declared the winner by 74 votes. In order for anything to change there must be a difference of at least 38 votes flipped from Biden to Trump.

But let’s say even one of those states produces demonstrable proof of election fraud. At that point the Republican legislatures of other battleground states that exhibited strange activity on election night… Georgia, Pennsylvania, and Michigan would be under a great deal of pressure to look into the integrity of their own elections. Suddenly, with an additional 52 electoral votes in play, things look a bit different.

Let’s further assume that the legislatures of Georgia and Pennsylvania determine that there was sufficient fraud in their states to flip the state’s vote to Donald Trump. With Arizona and Wisconsin, those states would bring the total to 57 electoral votes flipped from Biden to Trump, changing the totals to 249 to 289 and leaving Trump with a majority.

What then? Can a state reverse its electoral vote after certification and counting? Can states recall their electors post-inauguration? Can Congress meet and redo the vote count six months after an inauguration? None has ever been done and there is nothing in the Constitution about doing so. Can the House impeach the President for the fraud? Even if the GOP controlled the Senate a conviction would be unlikely because there’s probably little to connect Joe Biden with the actual fraud done on his behalf.

Can the Supreme Court order a new election? While the Constitution gives the Court no such power, in the Bizarro world of modern America that certainly seems to be no barrier. It is unlikely, however, as the Justices had two clear opportunities to resolve this problem and did nothing. When Pennsylvania Republicans sued seeking to throw out the clearly unconstitutional changes to voting law, the Court demurred. Unconstitutional changes such as these are of course the very basis for the Texas lawsuit that the Supreme Court refused to hear after the election. One state allowing their election to be stolen does indeed negatively impact the rights of citizens of another state if that activity results in a fraudulent president who runs the government of the United States under which all American citizens are governed.

Once the fraud has been demonstrated, America is going to find itself in a situation where it doesn’t appear that there is any Constitutional remedy in place. Are Americans simply supposed to acquiesce to the theft and allow the fraudulent president to be the actual president for the next three years?

No. That would be like a thief stealing your identity and looting your bank account and then once discovered, being allowed to keep it because, as we all remember from elementary school, “possession is 9/10ths of the law.” That was wrong in elementary school and it’s wrong in the Oval Office.

What can be done when the Constitution doesn’t address a bastardization of the constitutional process? Does a military junta take control and put Donald Trump back in the Oval Office? Umm… No! Does the 25th Amendment somehow come into play? No, because that would not remedy the situation. Does Biden resign? Unlikely, and again, it wouldn’t remedy the situation.

A Convention of the States as outlined by Article V of the Constitution? Maybe, but that’s a long process and would likely not occur within the timeframe of the next election.

How about a shadow government? Does Donald Trump build a replica of the Oval Office at Mar-a-Lago and show the world what a real president would do in whatever circumstances the imposter president finds himself in?

Do true patriots take to the streets and use violence and intimidation to wreak havoc from sea to shining sea the way BLM and Antifa did last year, and maintain it until the Democrats capitulate?

None of those ideas is an ideal solution. An ideal solution would essentially reverse the inauguration of Joe Biden and inaugurate Donald Trump as the rightful president.

Many pundits are suggesting that Republicans should dig deep and focus on 2022, both at the local and the state level so that the GOP can take back the House and the Senate. While that’s true, it’s not sufficient because it doesn’t address the fraud in the first place.

If it’s possible to steal the presidency with impunity, what office in the nation is beyond reach? The simple answer is none, and that matters because the government has police power and once the Constitution becomes superfluous, the coercive powers of government suddenly have no limits. And for those who say that the Constitution still stands, the Constitution is nothing more than a piece of paper. It is the citizens’ loyalty to that Constitution and the system built upon it that make it work.

A New Declaration for American Citizens Empowered by an Old Constitution

In America, January 2nd, 2021

In this, the Declaration of the seventy five million Americans who sought to have their votes count, who sought to be governed by the United States Constitution, who sought to live free in a nation of laws, we borrow from the words from our Founding Fathers:  When in the Course of human events, it becomes necessary for one people to dissolve the political bonds which have connected them with another, and to assume among the powers of the earth, the separate and equal station to which the Laws of Nature and of Nature's God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.--That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, --That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness. Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed. But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security.--Such has been the patient sufferance of these Citizens; and such is now the necessity which constrains them to alter their former Systems of Government. The history of the present Government of the United States is a history of repeated injuries and usurpations, all having in direct object the establishment of an absolute Tyranny over American Citizens.

To prove this, let Facts be submitted to a candid world.

Certain members of the United States Congress, current and former members of the Executive Branch and sympathetic members of various agencies of the United States Government did impede the good working order of the United States government and undermine the respect of law among American Citizens by spending years and precious resources proffering a known fiction of treason against the American President and in doing so inhibiting his ability to govern the Nation in good order.

Government officials from across the United States have exaggerated and exploited the threat of a virus to eviscerate the natural right of American Citizens to live their lives as free men and women and pursue the ability to provide for their families and serve their communities.

The American Government has expanded its control over American Citizens far beyond anything for which it was rightly empowered in the Constitution of the United States.  By establishing an ever growing unaccountable bureaucratic leviathan which seeks to control the lives of Citizens the Government has eliminated the accountability which is inherent in a Government that derives its just powers from the consent of the governed.

And most destructively of all, enemies of freedom, along with their Press brethren and tyrannical Social Media enablers did conspire to deprive the American Citizens of their right to keep their government accountable by thwarting the honest and fair election for the President of the United States of America, thereby rendering all future elections moot, rendering toothless all procedures for limiting Government, rendering the Constitution of the United States to the dustbin of History. 

A government no longer accountable to those whom it governs has become by definition a tyranny. 

In every stage of these Oppressions We have Petitioned for Redress in the most humble terms: Our repeated Petitions have been answered only by ridicule, repression and indifference unworthy of a government empowered by its citizens. 

Nor have We been wanting in attentions to our Government overseers.  We have warned them from time to time of their attempts to extend an unwarrantable jurisdiction over us. We have reminded them of the circumstances of the Rights and Freedoms enumerated in the Constitution of the United States.  We have appealed to their native justice and magnanimity, and we have conjured them by the ties of our common kindred to disavow these usurpations, which, would inevitably interrupt our connections. They too have been deaf to the voice of justice and of consanguinity. We must, therefore, acquiesce in the necessity, which denounces our Separation, and hold them, as we hold the rest of mankind, Enemies in War, in Peace Friends.

We, therefore, the freedom revering Citizens of the United States of America, appealing to the Supreme Judge of the world for the rectitude of our intentions, do solemnly publish and declare, That a Government of the United States headed by an interloper is not representative of the will of the People, is illegal and against the Constitution of the United States and therefore all political connection between them and the free citizens of the United States ought to be totally dissolved. 

We beg that this dissolution be remedied before it ever comes to fruition by an honest accounting of the most recent Election for President of the United States of America by the Congress and the inauguration of the rightful victor as the next President of the United States. Senators and Representatives swear an oath that begins:  "I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same;” They have sworn to defend the Constitution and the Republic from enemies who would usurp the power of consent of the Citizens of these United States. 

We Respectfully beg they do that which they have sworn and remedy this usurpation before calamity befalls the Nation and the Freedoms endowed by the Creator and guaranteed by the Constitution become mere historical anomalies in the long march of Human Civilization.

The Hill to Die On: Will Ted Cruz and Rand Paul Take Their Oaths Seriously and Help Mo Brooks Save the Republic?

In 1776 56 brave patriots signed their names at the bottom of the Declaration of Independence; a document that spelled out the specifics as to why the 13 colonies were making a break with England and King George.

Signing that document was treason against the British and every single man, some with names you know, Benjamin Franklin, Sam Adams and of course John Hancock, and some you may not such as Thomas McKean, Button Gwinnett and Arthur Middleton, risked literal life, limb and property by doing so. Had the British prevailed, they very well may have ended their days in front of a firing squad or at the end of a hangman’s noose. Yet still they signed.

The interesting thing is, only about a quarter of the population actively supported the break with England at the time the Declaration was signed. Another quarter, largely those whose fortunes benefited greatly from the connection with England (which some of the signers did themselves) wanted to remain part of the Empire, while fully half the population were what we’d call today “undecided”.

The reality is, leaders do what these men and others did… they led, they fought and they went home and convinced their fellow citizens about the righteousness of their cause and inspired others to join the fight. And in the end, they prevailed, and in doing so they set forth a path that changed the course of human history, much for the better.

Today America finds itself in a place not so different from that which the thirteen colonies faced 246 years ago. While the thirteen disjointed colonies faced the greatest empire the world had ever known, patriots today face the greatest propaganda machine in human history: The Democrat / Media / Tech Industrial Complex.

There are two big differences however. The first is that the thirteen colonies had the benefit of 54 men who were willing to stand up and challenge the King and Parliament in order to do what they knew to be right. Today patriots find a largely barren wasteland of leaders who are willing to stand up as the Democrats and their cabal seek to steal an election in broad daylight.

The other difference is that in 1776 war was the last option available to the patriots. In 2020 patriots still have one last option before something drastic… and the odds of it succeeding are as slim as those faced by the thirteen tiny colonies taking on the most powerful empire in the world.

As the Hill detailed earlier in the week, there is a Constitutional tactic through which the Republic can be saved… and make no mistake, that is exactly what is at stake here.

The tactic involves senators and representatives using the procedures outlined in the Constitution and the Electoral Count Act (ECA) to delay the acceptance of the electors to a point where the House would then choose the President, with each state having a single vote. Given that Republicans control a majority of the state delegations Donald Trump would be declared the winner.


This would be a long and arduous process, something like Jimmy Stewart’s character in “Mr. Smith Goes to Washington” spending a month reading scripture. No doubt the patriots who choose this path will be tarred and feathered in the press, have their families doxed on social media, and very likely be thrown under the bus by Mitch McConnell and other “leaders” in their own party. In a word, for a while their lives would be made miserable for the crime of standing up to those who would steal the election from the American people.

That’s what real leaders do. That is what real patriots do. In the 200 plus years since the signing of the Declaration of Independence and the ratification of our Constitution, millions of men and women have put everything – up to and including their lives – on the line after swearing a military oath that starts with this: “I do solemnly swear that I will support and defend the Constitution of the United States against all enemies, foreign and domestic;” Congressmen and senators take a similar oath, but it’s very rare that they risk much of anything, let alone their lives, after doing so. Most senators and congressmen leave office far richer than when they entered politics or at a minimum are able to parlay their service into lucrative lobbying positions on K Street. Can one be a politician and a leader and a patriot simultaneously?

Now is the time for patriots who serve in Washington to actually show that they take their oath seriously. While the Communist Chinese may indeed have influenced our election, the real threat to the Republic, to the Constitution, is a domestic one and it presented itself on November 3rd when fraud changed the outcome of the presidential election. Beyond the God given rights protected by the Constitution nothing is as sacred to Americans as their right to vote. Period. Full stop.

If the integrity of our elections is lost then nothing else matters because at that point no one is accountable to voters, the rules and the Constitution ceases to be anything but a faded piece of paper. As such, now is the time for patriots in Washington to stand up and actually do that which they swore to do. No more assuming “We’ll win next time”. No more thinking the other side plays by the rules. No more assuming that everything will blow over and we’ll be back business as usual soon. No. This is the hill to die on because beyond this hill is a Stalinist tyranny like the one George Orwell warned us about. Tens of millions of Americans have seen the writing on the wall as written by Antifa and Black Lives Matter and AOC and other Democrats who seek to punish Trump supporters. Not sure? Think Stalinist purges can’t happen here? Think again. Look at what was done to Donald Trump over the last four years when every single Democrat involved knew that the charges were fiction. And he was (and is) a billionaire President loved by tens of millions and they only controlled ½ the legislature for ½ his term! Once in power imagine what they will do to average Americans who just trying to make ends meet and wants to be left alone, a small businessmen who just want to make a living, or senators or congressmen who stand in the way of their plans for domination…

There is nothing usual about America in 2020 and what we’ve just experienced was not just another election loss. It was a coup in the literal sense of the word and the Democrats were willing to do it right in front of us because they were pretty sure that no one would do anything about it. This is a call for Ted Cruz, Rand Paul and all ostensibly Republican senators join Congressman Mo Brooks and his army to show Democrats that they were wrong in their calculations and that you take your oath seriously and will fight to protect the United States from these domestic enemies of freedom. It will be challenging and there will be countless people seeking to derail you, from both sides of the aisle. No doubt the media, friends and maybe even some family may seek to knock you from the path – as Benjamin Franklin’s son sought to do with him – but if you keep the faith, if you fight the good fight, we will win and when the history of the 2020 election is written you will find yourselves in the same company as those 56 intrepid men, they having birthed our nation and you having saved it.
