10 Things Donald Trump Can Do To Make America Great Again

As I wrote last week, I think Donald Trump is going to win. I think he’ll take office in January, but the two months between will be chock full of Democrat tricks trying to delegitimize his victory, coordinated riots seeking to push America into chaos before he’s inaugurated, and the swamp seeking to do everything it can to insulate itself from the potential consequences of a Trump presidency. 

January 20, 2025 will not be a checkered flag moment. On the contrary, it will be the starting line for a four year race to save the nation.  As such, we need to look at what exactly needs to be done going forward and below is a list of 10 things President Trump needs to do. There’s much more, but I’d suggest this is a place to start.

#1 – Seal the border and deport all 30 million illegal immigrants. Just like last time, Democrats, RINOs and activist judges are going to try and stop him.  He cannot let them succeed.  Begin by declaring the nation is under assault and deploying the Army to the border until the wall is complete. The first step in deporting the millions of illegals is stopping all of their benefits. Next, given that they will need food and shelter when the benefits are curtailed, establish exit processing centers where they can come and find shelter and food and be processed out of the country.  Next, stop all federal funds from going to “sanctuary” states and cities who do not cooperate.  Finally, enforce federal legislation against hiring illegals, and send employers to jail.  Of course none of this will be enough, but it’s a beginning.

#2 – Resurrect the 10th Amendment.  For those who don’t remember, the Amendment reads: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

Most of the things the federal government does are simply unconstitutional. Assign a crack team of constitutional scholars / lawyers to go over the federal government with a fine tooth comb. Starting with the federal government’s list of its own agencies, examine every single department and agency and highlight those for which there is clear Constitutional authority. For every other one, craft a plan for their dissolution. For easy things like NPR, PBS, NEA etc. which are inconsequential, make the dissolution immediate. For others, like HHR and other wealth redistribution programs, where sometimes generations of families have been raised to suckle at the government teat, create a three year plan that reduces their budget by 33% a year for three years, ending with the complete dissolution at the beginning of year four.  For those agencies / departments that remain, implement zero based budgeting so that they are forced every single year to make the case for the money they are seeking from the federal government. 

#3 – Restructure the Justice Department, the FBI the CIA and the Pentagon.  Fire the leadership of all four – up to and including the top 100 senior managers / officers of each with severance packages. Investigate every one of them and for those suspected of treason / incompetence over the last eight years and charge them. For the rest, give them the opportunity to demonstrate they deserve to be part of the organization if they’d like their jobs back. Their success on that score should be based on two things, competency and a demonstrated allegiance to the Constitution. 

#4 – Ban every DEI program and race or sex based program in the United States government.  Make it crystal clear to Americans that every single job, scholarship or contract associated with the federal government is based on one single thing, merit.  At the same time make it known that corporations making policy based on DEI and the climate change cult are violating their fiduciary responsibility and that officers and directors collectively and individually are liable for those violations. 

#5 – Abolish the IRS and the income tax and implement a flat tax or better yet, the FairTax.  This will, perhaps more than anything but the 10th Amendment action above, drive a stake through the heart of the swamp beast.  There is a reason that the seven richest counties in America (out of a total of 3,143) are suburbs of Washington, DC: government and lobbying.  And few things drive more lobbying than tax breaks. 

#6 – Negotiate a peace between Russia and Ukraine.  Neither wanted this war and a month after Russia invaded there was a peace deal on the table both supported, until it was torpedoed by Joe Biden.  This useless and wasteful war is accomplishing nothing while costing hundreds of thousands of lives and causing trillions of dollars of damage to the participants and the rest of the world. 

#7 – Remove the United States from the Paris Climate Accord. This globalist, anti-capitalist fiction is nothing more than an attempt to give elites control over the lives of citizens around the world and drives the destruction of prosperity everywhere its tentacles reach.  At the same time, eliminate every “climate change” or “green energy” driven policy in the federal government and make a plan for unleashing America’s true energy potential from fracking and nuclear power.

#8 – Use Congressional power vested in it by Article I, Section 4, Clause 1 of the Constitution (the Elections Clause) to guarantee federal election integrity by requiring Voter ID and paper ballots in every state and outlaw mail in ballots for anyone other than the military. 

#9 – Craft a plan that sunsets every law and regulation in the federal register within a decade.  Put a framework in place for Congress to reevaluate every law on the books over the following ten years and each one should face a renewal vote. Those that pass with 60% of both houses can remain on the books indefinitely while all others sunset after a decade unless passed again. 

#10 – Pass a law that explicitly states that it is illegal for government agencies to coerce or motivate private enterprises to accomplish desired tasks that are illegal for the government to do on its own.  This applies to bank coercion of disapproved industries, data gathering on US citizens or censorship of free speech among others. 

Of course, as Trump learned in his first term, the swamp is a tenacious beast that will not go gently into that good night.  There will be gnashing of liberal teeth, there will be activist judges with God complexes trying to throw judicial roadblocks everywhere and there will be RINO calls to work across the isle.  He should ignore all of that and march swiftly towards returning the government to its originally intended, natural, limited state.  Doing so will unleash an economic and entrepreneurial juggernaut never before seen and will be sufficient to create a giant budget surplus.  That surplus will be sufficient to eliminate the national debt in less than a generation and with it will go most of the problems America faces today. 

There’s of course much more, but if he does half the things on this list Trump will easily have earned himself a place on Mt. Rushmore.

FairTax 101: Making America Great Again

President Trump recently floated the idea of eliminating the federal income tax. That tax became a fixture in 1913 when Congress ratified the 16th Amendment. The first U.S. Tax Code was about 400 pages. Today, with everything included, it’s more than 70,000 pages! Initially, the income tax was 1% on all incomes above $3,000 ($95,000 in today’s dollars) and applied to only 3% of the population. Today, the graduated rates start at 10% for families earning more than $30,000 and go up to 37% for families earning above $609,000. The rates vary greatly: The top 1% of taxpayers pay 45% of all income taxes, the top 25% pay 89%, and the bottom 47% pay 0%.

Trump understands that the tax system is a yoke on the neck of American prosperity. According to the National Taxpayer’s Union, Americans spend approximately $260 billion a year complying with the federal Tax Code, most of which goes into the pockets of accountants and lawyers. And that doesn’t count the countless billions businesses spend adjusting their operations to reduce their tax burden in the first place.

Trump has floated the idea of replacing the income tax with tariffs on imports. That’s neither feasible nor a great idea, but the notion of scrapping the current system is a compelling one, particularly if it eliminates the IRS. There’s a great (albeit not perfect) replacement for our current system, one that would replace the current dysfunction and replace it with something that would give the American economy a much-needed jolt: The FairTax.

Basically, the FairTax replaces all federal taxes, including Income, Corporate, Social Security, and others. It replaces all of them with a single retail tax to raise a similar amount.

Here’s an example of how it works: Let’s assume it costs $1.00 for a loaf of bread. According to the people at FairTax.org, $.22 of that $1.00 represents the aggregated federal taxes paid by the baker, distributor, retailer, and every other entity who had a hand in putting that bread on the shelf, including the individual income taxes their employees pay. The bottom line, though, is that you’re paying $1.00 for a loaf of bread.

Under the FairTax, all those aggregated taxes would be eliminated. The loaf’s cost would then be $.78, which includes all the inputs and profits from the farmer, distributor, retailer, etc. At retail, the tax would be $0.23, making the bread’s price $1.01, which is almost the same as before.

But here’s the kicker: Under the current system, when you earn $1.00, you only have between $.63 and $.90 cents left after taxes with which to buy that bread. Under the FairTax, when you earn $1.00, you have $1.00 left after taxes. (You can find the extra penny between the couch cushions!)

Given that the bread’s price stays basically the same, one might ask, “What’s the point?” Well, there are many beyond that whole paycheck in your pocket.

1. Spur Investment in America:

America could use a real shot in the arm. GDP growth is miserable (currently 1.3%). “But at least it’s growing,” you say. Not really.

The government will print (borrow) $1.2 trillion this year to pump into the economy, which will likely come in at about $28 trillion. So, basically, the government is adding 4.2% to the economy via debt, which will have to be paid back, even as GDP grows by less than 1.5%! That’s not real growth. The FairTax would fix that. There’s no single thing Congress could do that would more effectively spur investment in the American economy.

The average corporate income tax around the world is 23%. By eliminating federal taxes, Congress would make America an investment magnet. Currently, the world invests $1.2 trillion across national borders annually, $400 billion of which comes here. (While immigrants send $800 billion out of the country annually.)

By dropping the income tax to zero, America would spur companies worldwide to prioritize investment in the United States and create millions of new jobs. At the same time, it would motivate American taxpayers to bring home most of the $4 trillion they hold offshore, as would US corporations that hold additional trillions of dollars outside the country. Both would spur investment and create jobs.

2. Spur Entrepreneurship:

American employment is driven by small businesses that are mostly owned by individuals who report their income on their personal tax forms. By eliminating federal taxes and allowing entrepreneurs to keep more of their money, the FairTax would spur more Americans to become entrepreneurs.

3. Increased Competition and Innovation:

As efficiency returns to the market and more entrepreneurs are motivated to start businesses, competition will increase, which leads to more innovation and lower prices. Consumers will not only keep more money in their pockets, as competition drives down prices, those same dollars will buy even more.

4. Limit Congresses’ Power:

Eliminating the Tax Code would remove Congress’s ability to use it to punish disfavored industries and reward pet projects. Lobbyists would inevitably lose much of their power, as a significant amount of lobbying is predicated on enticing Congress to write industry-favorable tax laws.

5. Collect Taxes from Underground Economy:

Everyone who shops would pay the FairTax, including those in the underground economy who currently pay little or no taxes, such as illegals, drug dealers, or employees who are paid in cash.

6. Eliminate the IRS:

Does this need any elaboration?

7. Spur investment and innovation:

By taking the yoke of the Tax Code and IRS off the neck of individuals and businesses, the FairTax spurs investment and innovation. That puts the United States on the strongest economic footing possible on an increasingly competitive global stage.

8. Gives people their time back:

The FairTax frees individuals and businesses to focus 100% of their attention on starting, running, and expanding their businesses rather than contemplating countless tax consequences for every move.

9. A Boost for the Poor:

The FairTax gives every household a “prebate“ equal to the tax a person living on the poverty line would pay. As a result, every family in America who’s living at the poverty level would essentially receive a 22% increase in their income.

The FairTax is not a panacea—just ask the WSJ. It won’t solve all of America’s problems, and it won’t balance the budget, rein in government spending, or eliminate the vagaries of the business cycle. Some employers may try to reduce wages, which will spur labor disputes.

Those issues pale, though, when compared to the FairTax’s greatest benefit: It will begin reining in the imperial federal government, thereby taking the first step in returning America to its true foundation. That foundation is an understanding that the primary function of government is to protect its citizens’ freedoms and allow them to pursue prosperity and happiness unfettered by the tyranny of an oppressive state. Such a resurrection of the 10th Amendment would by itself make the FairTax a worthwhile endeavor and, indeed, go a long way to Making America Great Again.

Don't Look Now But The Democrats of 2020 are Eerily Similar to the Nazis of 1933...

One of the brilliant things about the United States’ founding fathers was their understanding of human nature. They understood that it is the nature of man to seek to accumulate power. It’s been that way throughout human history. The seemingly unquenchable thirst for the accumulation of power has created empires across the globe. In Africa you had the Egyptians, the Songhai and the Carthaginians. Asia had the Ming, the Han, the Mongols, and of course the Ottomans. Europe had the Greeks, Romans, and the Spanish. The Americas had the Mayans, the Aztecs and the Incas. The British eventually assembled an empire that literally circled the world.

The parts of the world that were not subsumed into giant empires were part of smaller civilizations of varying sizes that operated, in most cases, through the accumulation of power via conquest and slavery. It was usually the conflict or potential conflict with competing powers that dictated how large a nation or an empire would grow. Because, after all, it is largely a trait of men to seek to accumulate more power until prudence dictates not doing so – and even then in some cases prudence is not much of a deterrent. And that applies even more to competing powers within a state than to those between states.

Our founding fathers knew this and decided to craft a Constitution to yoke the darker nature of men. Thus we have the federal system, where states have some powers and the federal government has others. The federal government would handle most large national issues while states would handle those closer to the people.  We have a separation of federal power between three theoretically equal branches of government. Within the legislative branch – which at the time of writing was expected to be the first among equals – there is a separation between the houses, and within the houses different powerbases. The states appointed Senators and the citizens elected the Representatives. Add to all of this the staggering of terms of office and you have a vehicle that was designed to limit the powers of mobs and keep any single group from being able to play on the emotions of men and take power.

And finally of course, for the single most powerful limit on the accumulation of government power, you had the Bill of Rights which clearly articulated the rights of the people, both individual and collective, that could not be tread on by the government. Free speech, a free press, free practice of religion, the freedom of assembly, a right to be secure in their persons and homes, and most important of all, because it protects all the others, the right to bear arms.

Our Constitution, like its authors, was and is not perfect, but over the years it’s evolved to ban slavery, grant equal application of laws and to expand suffrage. What is perhaps most interesting about the American Constitution is the fact that it’s guided the country for 233 years without a standing army of enforcers. Yes, there is an army of course, but it’s not used to keep citizens in line, because there is no line to be kept in. America was, for most of its history, a nation defined by freedom. Citizens could largely go about and do and say what they wanted. They could buy land where they wanted. They could start just about any kind of business they wanted. They could worship as they wanted. They could say anything that came to their minds… although whether or not that was prudent is another matter. Americans could move from place to place without permission of the government. They could, at the end of the day exercise their freedom, and that came from the Constitution. Barack Obama accurately stated “Generally, the Constitution is a charter of negative liberties, says what the states can't do to you. Says what the federal government can't do to you. But it doesn't say what the state or federal government must do on your behalf.” Obama meant that as a criticism of the document, but the fact is, that is exactly why our nation has endured and our freedom has endured so long and allowed us to change the face of the world along the way.

Which brings us to America circa 2020… Virtually all of those key elements that have kept our nation and her citizens free are today under direct assault… largely by the Democrat party and their partners in the media, academia, BLM and Antifa.

The left is today using the blueprint of the Nazi party to bring America as we know it to an end. Although the Nazi party came to power legally, constitutionally in Germany in 1933, prior to that the Storm Troopers (Sturmabteilung - SA) had spent a decade using violence and intimidation to cow some Germans into submission while simultaneously emboldening others to take up their cause. Once the Nazis were in power it was game over for a free Germany. The model of using the freedoms / rights afforded citizens of a nation to take control of that nation and then eviscerating those very laws and rights that allowed them to come to power in the first place can have staggering results. The Nazis took a dysfunctional post WWI Germany and turned it into an extraordinarily efficient killing machine, both of its own citizens and millions of others as it set the world on a course of war. That model of gaining power followed by death and destruction has proved highly effective in modern times from Robert Mugabe to Hugo Chavez to Vladimir Putin to Xi Jinping.

And today the left is seeking to use that very model to destroy America. Not sure? Just listen to them. They want to pack the Supreme Court. They want to eliminate the Electoral College. They want to eliminate free speech. They want to take away your guns. They have no compunction about using the IRS to stifle opposition. They have no problem using the FBI to overturn a fair election. They want to defund the police. They want to expropriate your property. They seek to rewrite American history. They want to implement laws based on race. They want to decide what communities look like. They want to keep schools and churches closed. They want to obliterate science. They want to decide what art you see. And of course they want to control the means of production to save the planet from the fiction of global warming.

And this is just the tip of the iceberg. Make no mistake, Democrats do not decry the violence in the streets, they seek to harness it. Make no mistake, Democrats hold no love for the Constitution other than how it can be used to bring them more power. Make no mistake, the Democrats don’t care one iota about your freedom or your liberty and they will take them in a heartbeat, if you let them. And this is not a bug in their system, it’s a feature. The Democrat party in 2020 no longer has a vested interest in freedom. Their only goal is power and subjugation. “Think what we believe or you’ll be cancelled.” “Say anything we don’t like and you’ll be cancelled.” “Support our opposition and you’ll be cancelled.” Today mostly what they do is get you fired, kicked out of school and shamed on social media, but with amorphous “hate crime” legislation advancing on every front, soon there will be literally no place to hide, because words no longer mean anything so the woke can literally characterize anything as “hate”. Taken individually some may argue these are nothing like Hitler’s fascist state. Perhaps, but collectively they are as clear a portent to the future as was Mein Kampf.

The most telling thing about this situation is that it’s not actually the Democrats per se leading it. It’s the Twitter and Facebook mobs. It’s the fascists at BLM and Antifa. It’s academia and the media. The Democrats (who nonetheless agree with all of it) are too spineless to actually believe in anything other than power. They are not leading, but rather playing catch-up, trying to run to get out in front of a parade that’s already in progress and pretend they're leading it to keep the money flowing in. Once in power – i.e. having the White House and both houses of congress – they will enact every over the top progressive policy BLM and George Soros can come up with because they understand that if they are not on the bleeding edge of wokeness, the mobs will simply replace them with people who are even more hardcore.

One wonders what the reaction to all of this will be from Americans who still value liberty and freedom… will they go quietly into that not so good night or will they “cling to guns or religion” and decide to push back against the new fascism?

For Marco Rubio being right on Barack Obama was a Pyrrhic victory

Marco Rubio’s campaign seems to have crashed on the rocks because of his… shall we say somewhat repetitive use of the phrase “Obama knows what he’s doing”, but the truth is, he was 100% right. The reason that so many people scoff at the notion that Obama knows what he’s doing is because the very notion of an American leader who seeks to destroy that which he leads is anathema to most rational Americans. And the truth is, Barack Obama doesn’t seek to destroy the nation he leads, he seeks to “fundamentally transform” it. Splitting hairs you might say, but there is a big difference between the two.

For Barack Obama the American glass is half empty. Sure, there’s water in the glass, but only what’s left after two centuries of whites stealing from blacks, Indians, Hispanics, after men taking from women and the rich taking from the poor. As such, it’s his goal in life to fill that glass up by redistributing that which has been stolen back to its rightful owners. At his very core Barack Obama is a divider – by race, by income by nationality among others – he is an anti-capitalist, anti western populist with fascist tendencies and no love for Christianity.

It’s only with that understanding that Rubio’s assertion makes sense. The nation that Barack Obama leads is not the same one most Americans live in. They inhabit the same geography, but they are not the same nation. It’s like the movie The Martian. Anyone watching it will recognize that it’s a serious movie that has a bit of levity scattered throughout. But somehow it was nominated for “Best Motion Picture: Musical or Comedy” at the Golden Globes. Most people would recognize that regardless of the category the Globes’ voters put it in, The Martian is no comedy. Similarly, the United States most conservatives inhabit is an imperfect one, but one full of opportunity, fueled by freedom and largely a force for good. For Barack Obama those same 57 states represent a nation defined by racism, inequality and oppression.

That is the nation that Barack Obama thinks he is leading and the one which he is seeking to fundamentally transform. And it’s easy to see that Rubio is right… he knows exactly what he’s doing. From Obamacare to the kneecapping of Chrysler shareholders to the using the IRS to muzzle Tea Party groups, it makes sense in the nation Barack Obama leads. This has been going on for seven years and most of the examples never find their way into the news. Here are three that recently did.
  1. The Internet. The Internet may be the most egalitarian invention in the history of man. It has connected more people and given more opportunity to more people than any tool in all of human history. It was created by the United States and has been largely free from censorship and government controls since its inception. Barack Obama sees the Internet as a tool of American domination and therefore is moving to remove American control of it and give it to an international body that will leave the Internet’s freedom subject to veto and manipulation by such freedom loving nations as China, Russia, Iran, Saudi Arabia and Venezuela.

  2. Economic freedom. American economic freedom is the engine that drove most of the world’s prosperity for a large part of the last century. The resilience and freedom of America’s markets and her entrepreneurs have led the world in almost every major economic development since 1900. American free enterprise has been the greatest driver of prosperity ever in human history, but under Barack Obama the United States has tumbled in economic freedom, to number 11 in the world (from number 6 when he took office.) And what causes such slippage? One thing: Regulation. Barack Obama sees America’s success as one of imperialism and outright theft, and he has used government regulation to stifle economic freedom at every turn, and the results have been devastating, resulting in the slowest economic recovery since the Great Depression.

  3. Government intimidation. Barack Obama is using the police power of government to achieve his ends. The Tea Party are not the only targets either. Barack Obama’s Consumer Financial Protection Bureau was recently outed for coercing Ally bank to agree to pay almost $1 billion in fines for racial discrimination, despite the fact that that internal documents stated they had no complaints nor any evidence of actual discrimination. Barack Obama sees America through race colored glasses and feels it’s his role to use the power of government to readjust settings. From the NLRB to the FCC to HUD, Barack Obama seeks to use the government to control more and more of Americans’ lives, winnowing down the spheres of freedom within which the outcomes can be decided by hard work and the choices people make.
At the end of the day, Barack Obama does indeed know exactly what he is doing. He is laser focused on one objective: Diminish America. Reduce her influence on the world stage and suffocate freedom and free markets at home. If you’ve been paying attention for the last seven you’ve seen him doing that and much more, and doing it very effectively. It’s simply not possible to rack up that level of success – as Obama defines it – without knowing exactly what you’re doing and being very good at it. Sadly for Marco Rubio, being right was a Pyrrhic victory.

Ted Cruz and the Oxymorons of Washington

Oxymoron: A figure of speech in which apparently contradictory terms appear in conjunction

One sometimes thinks the word started with our government: Government Intelligence… Government Efficiency... Government Accountability… In reality, it’s been around since the Greeks first coined the phrase, no doubt adding oxy to a word they probably used to describe their politicians too: Moron.

The Greeks may have invented the word, but the US government has perfected its common use. We have a welfare system whose ostensible goal is to get people back on their feet during hard times yet the numbers of people on the program never seems to go down. We have an education system that spends an ever increasing amount of money to somehow do an increasingly bad job of “educating” our students. Barack Obama has penned an agreement with Iran to keep them from getting nuclear weapons that actually rewards them for bad behavior AND makes it more likely they will get nuclear weapons!

As bad as those things are, and there are countless other examples, this very day we are witnessing possibly the single best example of government incompetence possible. So far this fiscal year the IRS has taken in more money than ever before, $2.6 trillion! Yet somehow they still managed to run a deficit of almost half a trillion dollars. And just two nights ago the utterly worthless GOP introduced a bill that enables even more incompetence in the form of a giant two year spending bill that would also raise the debt limit.  Somehow, Americans watch the middle class struggle while programs for the poor proliferate and the connected rich see their incomes skyrocket as Washington and its regulatory machine smothers more and more of the free market.

This is Washington unhinged. This is how liberalism works… including when enabled by the GOP. The government takes more and more of the citizens’ money, which leaves the citizens with less income with which to live their lives, nevermind have money left over to start businesses as they pursue the promise of prosperity. Seeing the resultant slowing economic growth, the government decides to come to the rescue by creating more regulations and more giveaways to make up for the “failures” of the free markets. It’s a viscous cycle… More government equals less freedom and less prosperity.

And today we have on full display the GOP’s disdain for freedom and prosperity. They seek crony capitalism for the specific purpose of ensuring their continued participation in the Washington cocoon – a comforting place where 7 out of the 10 richest counties in the country are located – out of a total of 3,143 counties! That Washington cocoon provides them with parties to attend, a staff to do their bidding, jobs for friends and family, introductions to the “right” people and of course a golden parachute upon leaving after having done enough favors for big business.

Unfortunately, this is likely a fait accompli as the anointed one, Paul Ryan, the soon to be head squish has jumped onboard. The result of this betrayal of the American people makes it only that much more important that voters look to someone like Ted Cruz to be the next president. We are at a point where the government continues to take more and more of our money, yet continues to demand to borrow even more, and this is while the GOP has both the House and the Senate. Ted Cruz has both the intellect and the intent to thwart the liberal enablers in the GOP. No one else in this race has shown the willingness to fight the GOP establishment the way Cruz has. Today’s treachery puts the nation on notice. If you want a change from the failure of liberal policies and crony capitalism, put someone in the White House who does more than talk a conservative game. Put someone in there who has shown a willingness to fight the leviathan of government and it’s GOP enablers. Someone who's not an oxymoron... That man is Ted Cruz.

Why I'm beginning to disagree with Sarah Palin about the impeachment of Barack Obama

I love Sarah Palin, but I’m beginning to disagree with her on impeachment.

Article II, Section 4 of the Constitution says the following about impeachment: The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors. The House of Representatives has the sole power to impeach and the Senate the sole power to convict.

I’ve thought for some time that Barack Obama should be impeached. The IRS scandal alone was far worse than anything Richard Nixon ever did, or even thought of doing. Unfortunately we don’t thus far have a smoking gun. Benghazi may meet the threshold as well on the basis of “high Crimes and Misdemeanors” in the dereliction of duty as Commander in Chief. Then of course there is the deluge of Obamacare violations. Repeatedly the law says one thing and Obama has done the opposite.

While I have no doubt Barack Obama deserves to be impeached, I’m no longer sure that he should be. It is most certain that the Republicans in the House could gather the votes to impeach.  The point of impeachment however is not impeachment... it's conviction.  Unfortunately however there is no way in hell that it would be possible today to get 67 votes for conviction in Senate. Former Louisiana governor Edwin Edwards once said about his reelection prospects: "The only way I can lose this election is if I'm caught in bed with either a dead girl or a live boy". Barack Obama might paraphrase that in reference to his conviction prospects in the Senate. Although I’m skeptical that even then the Senate would convict…

It’s not because I’m afraid he won’t get convicted that I no longer believe he should be impeached however. It’s because I no longer think it’s necessary. Why? Because Barack Obama is a lame duck. Not just lame in the traditional sense of presidents being lame in their second terms. But lame in the sense of being broken. Today his approval rating sits at 39%, the lowest of his presidency. While there seems to be a subset of Americans, about 40% of the population, who seem incapable of recognizing, or refusing to recognize incompetence when they see it, Barack Obama is making it much more difficult for those misguided souls to keep their heads in the sand. His incompetence and perfidy are becoming legion. Obamacare alone would make the case… and consumers will be livid when their subsidies evaporate. Then there’s the administration’s stonewalling in the IRS scandal investigation as more and more information emerges demonstrating its betrayal of our Constitution. Then there’s the chaos in Iraq and reversals in Afghanistan. His bludgeoning of Israel in its battle with Hamas. His impotent response to Vladimir Putin’s aggression and the shooting down of flight MH17. But perhaps most of all, Barack Obama’s betrayal of the American people can be seen in his efforts to “transform” the United States into a third world country by essentially eliminating our southern border while simultaneously inviting every Central American child to swim across the Rio Grande and become a Dreamer.

And that's the reason why Barack Obama should not be impeached. Because while the country and the world are in the grip of chaos and worse, he’s busy… playing golf. He’s attending fundraisers. He’s going on vacation and buying a $4.5 million home in Palm Springs. And Americans can see that. They see his indifferent attitude towards actually solving problems or leading, whether it’s the collapse of the border or the fires burning across the footprint of the Ottoman Empire. Even those predisposed to worship at the altar of Barack Obama can’t help but recognize his disinterest in the duties of actually governing. And that’s the point. To paraphrase Napoleon, When your enemy is in the process of destroying himself, don’t interfere.

Were the GOP to impeach Barack Obama now they would not only be interfering with Barack Obama’s immolation of his legacy, they would be throwing him a life preserver. The debate would suddenly shift from the reality of Obama’s incompetence to the fiction that he is being persecuted because of his race. That is perhaps the only thing worse than the nation collapsing under Barack Obama’s stewardship… the nation collapsing under Barack Obama’s stewardship and no one paying attention to the fact that it’s Barack Obama who’s causing the collapse.

Now this calculation could change. If we find an IRS smoking gun with Obama’s prints on it that even hardcore leftists can’t ignore, then impeach him. Absent something like that however there is no reason to rescue Obama from the morass he has brought upon himself. Doing so won’t help the country and will only turn him into a victim and help obscure his reputation for posterity. And that would be the ultimate disaster as future generations would never see the abject failure that was the anti-American presidency of Barack Obama, but instead would read about the heroic legacy of a black man persecuted for his race who was never given a chance.

Barack Obama, 2016 and the Burning of the Reichstag

Let’s face it, most Americans expect our politicians to lie. At least about the little things. Typically politicians try to keep things opaque so that they can easily massage the historical record once things don’t work out or the winds change. “I’ll put America back to work”. “I’ll bring home jobs.” “I support a fair tax system.” “I support education & women’s rights.” The less precise that a politician’s statements, the fewer people they will alienate, and in an American political universe of negative campaigns, that often seems to be the road most traveled. We expect them to lie about little things, but be aboveboard about the big, important things.

Then there is Barack Obama. News came out this week that provided confirmation that the Obama administration lied to the American people about Benghazi. On September 16, 2012 Susan Rice made the rounds of five talk shows telling the nation the attack on Benghazi that took the lives of 4 Americans was the result of spontaneous protests in response to an anti Islamic YouTube video. To many people that seemed absurd, but some were unsure and were willing to give the administration the benefit of the doubt. When it became clear that that narrative was simply false, the administration claimed that the talking points were directed by the State Department and the CIA. On Tuesday that was proved a lie as an email from the White House addresses Benghazi specifically in terms of blaming the video and not terrorism or policy failures.

This fits a pattern for this White House. And what makes it so perfidious is that it’s not to protect the country, but rather to save Barack Obama’s political skin. Again and again they have lied to the American people about big things, important things. And it’s gotten worse over time. At first it was passing of Obamacare, something sufficiently incomprehensible that Nancy Pelosi said “We have to pass it so we can find out what’s in it.” Barack Obama promised If you like your doctor you can keep your doctor and If you like your insurance, you can keep it despite the fact that the administration knew that to be specifically false.

Then it was using the police power of the government, embodied by the IRS, to seek to shut down the voice of their opponents. Certainly Americans would not be surprised that political opponents of a president sometimes find themselves being audited. But this was much more than auditing. This was the government seeking to use its power to muzzle opponents by limiting their ability to raise funding. And of course Barack Obama assured the American people that there was nothing political going on. In a free nation is there any more pernicious act than a government using its police power to repress its opposition? No. In America where we spend about as much on political campaigns as we do on chewing gum annually, even a modest limitation on the spending of your opponents can pay handsome rewards.

And now the most treacherous if not traitorous thing of all is the abject manipulation of the truth about the death of a US Ambassador in order to sway an election. We now have proof that six weeks before the 2012 election the White House manipulated the media and the message related to Benghazi for the specific purpose of supporting the illusion of Barack Obama’s foreign policy competence and his claim that al Qaeda was on the run and had been “decimated”.

So the question is, now that the election is over, what’s next? We already know from his own message to Putin that he believes he has greater flexibility now. Since there is no pending election through which the American people might put him in the unemployment line, what limits exist? He has pushed the envelope from taking away liberties to oppressing opponents to lying about his administration’s responsibility for the loss of life of a US Ambassador and three others. It’s not likely that he can get a repeal of the 22nd Amendment through, but one has to wonder, could he or would he manufacture some crisis that would cause the election of 2016 to be postponed? Perhaps indefinitely? Is it possible that the DHS might use events like the one down in Nevada with Cliven Bundy and his supporters to implement some sort of unprecedented nationwide emergency powers to battle people the DHS already considers potential terrorists… You know, like veterans or anti-abortion activists or border enforcement types? Is it possible that he could fall back on his community organizing skills to inflame his supporters to occupy government buildings around the country and demand changes as the students did at Columbia in 1968?

Sure, this might sound farfetched, but we’ve covered a lot of ground towards fascism over the last six years. No one gets elected in a democracy saying “I want to take away your rights” although they often do get elected saying they are going to take away someone else’s. Once they have their hands on the reins of power however, particularly of the DOD and DHS, it’s only a president’s integrity and appreciation for America’s greatness above their own that keeps him from seeking to manipulate the levers to extend his stay. (Remember, Nixon left without putting up a fight beyond the courtroom.) With Barack Obama, a man with little compunction about lying, an ego that makes Donald Trump look like a wallflower and who has both a disdain for the Constitution and a love affair with Executive Orders, I find myself a little concerned about the potential for a contrived American version of the burning of the Reichstag.

From your Facebook passwords to Section 8 housing... why Barack Obama should be impeached for dismantling the very Constitution he swore to preserve, protect and defend.

We all know that Barack Obama was a Constitutional Law professor at the University of Chicago. He spent more than a decade lecturing on what is possibly the greatest document ever written by men. Later, when elected to the Senate and then the White House he swore to defend that same Constitution. Despite all of that, one has to wonder, does Barack Obama not actually understand the document he has spent a quarter century studying, teaching and “defending” or is he some kind of self directed progressive Manchurian Candidate? Whichever is the case, one thing is unassailable, Barack Obama is a using the power of the presidency to eviscerate the Bill of Rights. Not the whole thing mind you, but enough to turn the granite foundation of American freedom into a termite ridden balsa wood floor that could give way at any moment.

So how has Obama undermined the Bill of Rights? Let us count the ways…
1st Amendment: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press…”
Just to be clear, in this context the framers said Congress but meant the federal government because they expected Congress would make all laws and the President would execute and enforce them.

Freedom of Speech: President Obama used the IRS to quash the voices of the most rabid and politically dangerous of his opponents, the Tea Party and in doing so stole the 2012 election.

Freedom of the Press: Obama’s Justice Department purposely bypassed judicial review and secretly subpoenaed records from the AP as well as the personal phone records of a number of its editors and reporters in an attempt to discover the source of a leak about terrorist plots. This is the same Obama Justice Department that characterized routine reporting practices as criminal activity by labeling Fox News reporter James Rosen a "co-conspirator" for reporting on North Korea and then tracking both his professional and personal actions and emails. In these cases, and perhaps others yet unknown, the President and his team sought to use the police power of the state to intimidate the press.
2nd Amendment: A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.
Right to keep and bear Arms:  The Obama administration has spent much time and effort seeking to find ways to limit American’s right to bear arms. From supporting UN treaties that require gun registration to floating the idea of forcing psychologists to report on your gun ownership, to talking about working on gun control “under the radar”, President Obama has made it clear that the 2nd Amendment is no barrier to his desire to eliminate our right to own guns.
4th Amendment: The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

We’ve all heard of the NSA gathering data on citizen’s phone calls and Internet surfing habits without warrants, which would seem a crystal clear violation of the 5th Amendment. Now we discover that the Obama administration is demanding that major Internet companies turn over users' stored passwords. required to have data collecting black boxes installed. Those boxes collect a variety of data from how fast you’re going to whether or not you’re wearing your seat belt to how long it took you to step on the brake. Add to that the fact that most cars will have OnStar like capabilities and the government could pull a NSA redux and easily know everything about every trip you ever make as well as listen to everything you say the entire time.
That means that potentially a phalanx of nameless, faceless bureaucrats from the IRS or the NSA or the DHS can sit there and scrutinize your every message or like or post on Facebook or Match.com or any other social media platform. And it’s not just online.  In 2012 the NTHSA proposed that by 2014 all cars be requiredto have data collecting black boxes installed.  Those boxes collect a variety of data from how fast you’re going to whether or not you’re wearing your seat belt to how long it took you to step on the brake.  Add to that the fact that most cars will have OnStar like capabilities and the government could pull a NSA redux and easily know everything about every trip you ever make as well as listen to everything you say the entire time.

5th Amendment: …Nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb, nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
This Amendment too has come under particular attack by the Obama administration.

Double jeopardy:  After the jury returned a not guilty verdict in the Trayvon Martin trial, the Justice Department actually set up an email address with the specific purpose of soliciting tips so that it might help them bring charges against George Zimmerman for the same act, only under a different statute.

...private property be taken for public use, without just compensation:  Then there is the Takings Clause that has been felled by Barack Obama’s hand. In 2009, after failing to intimidate two state retirement funds who held secured Chrysler bonds, the President ignored contract law and simply took their property for the government and the UAW without just compensation.

...private property be taken for public use, without just compensation:  Finally there is the administration’s plan to achieve their diversity goals by using a variety of tools to force communities – and indirectly owners of suburban rental properties – to accept government Section 8 vouchers. Section 8 is a welfare program where government pays most of the rent and utilities for low income renters. While some landlords may be happy in the short term to have tenants whose bill gets paid on time, in the long run they and their neighbors will experience a significant “taking” of their property as the introduction of Section 8 housing almost invariably leads to dramatic increases in crime rates followed by significant declines in property values.

And this of course is only a partial listing…

Barack Obama sees the Constitution in general as little more than a list of suggested rules to be considered and the Bill of Rights in particular as a Maginot Line to simply be bypassed whenever deemed necessary. The unfortunate thing about all of this is that federal power is like Pandora’s Box, once it is unleashed, it’s almost impossible to rein in. The perfect example of this was last week’s House bill seeking to limit the NSA’s power to spy on Americans. It failed.

What makes this particularly unseemly is the fact that the Bill of Rights was the key to the ratification of the Constitution in the first place. Had it not been for the Massachusetts Compromise it’s likely that the Anti-Federalists would have carried the day and the Constitution would never have been ratified.

Given the central role the freedoms codified in the Bill of Rights have played in the triumph and prosperity of the United States, it’s no wonder that Barack Obama seeks to disembowel it. In 2008 he promised to “fundamentally transform the United States”. He has achieved his goal. Thanks to Barack Obama, in 2013, before a citizen can begin thinking about setting off on some new adventure, begin solving some new (or old) problems, begin dreaming of new ideas or innovations, consider starting a new company or doing any one of the millions of things Americans have done for centuries, we must now stop and wonder what that act might look like if it were pulled out of context by some apparatchik, wonder how our private conversations might sound if heard by a government lawyer who knows nothing about us and for whom those words were not intended, wonder what might befall us if we criticize the government or what might become of our investments if they end up on the wrong side of some government redistribution scheme… In other words, we have to imagine we're living in George Orwell's 1984. 

All of that is by definition the opposite of freedom and they are the kinds of fears dictators seek to instill in their subjects. That is exactly why the Founding Fathers insisted on a Bill of Rights as the price for the ratification of the Constitution with its federal system. Barack Obama has driven a knife through the heart of the freedoms Americans fought and died for for centuries and he should be impeached for dismantling the very Constitution he swore to preserve, protect and defend.

NSA, FBI, IRS and the 4th Amendment: Why freedom matters…

I remember once when I was in college I took a trip home to the DC metro area with my girlfriend. She and I went to the movies not far from where my mother lived in a rather rough part of town called Capitol Heights, MD. I have no idea what we saw. I do however remember that we had a terrible time, and it had nothing to do with what was on the screen and everything to do with what was going on in the theater.

Not long before this at a different theater a few miles away in Oxen Hills, MD. I was standing in line with a friend and I saw two teenage girls fighting not 10 feet away. I grabbed one of the girls and someone else grabbed the other. That’s when I noticed that the other girl was bleeding profusely and the girl I grabbed had a 12 inch steak knife in her hand. It was something about a baby’s daddy is all I knew. Needless to say we didn’t see a movie that night.

So at this different theater we were hoping for better results. As soon as we sat down I wasn't so sure. People were talking to the screen, smoking in the seats and being rather raucous. My girlfriend mentioned the smoking and I said that if that was the only problem we encountered that night we would count ourselves lucky.

I mention all of this because when you think your life may be in jeopardy, it’s hard to enjoy entertainment… and that’s the whole point of movies. Movies require your buy in for success. They require you to turn off reality. They require you to become connected with the characters. They require the suspension of disbelief and much more if you are to get everything out of the movie and enjoy two hours of entertainment.

If you can’t do any of those things you can’t become engaged in the movie. If you’re worried that someone’s going to pull a knife, a gun or set the place on fire, you’re going to be busy looking around to scan the theater, listening for commotion or trouble and generally paying attention to everything but what’s on the screen. As a result you'd probably miss much of the storyline and likely would end up doing little more than wasting your time and money.

Just as movies require your buy in for success, so too does life. And that’s the problem with all of this seemingly ubiquitous government surveillance. The danger is not so much that Big Brother is watching and trying to control our every move. They don’t have to. Our knowing they could be is enough. Somewhat like the Observer Effect in physics, the observing itself impacts the people being observed.

Think about it this way, if you think it’s tough to enjoy a movie when you’re worried about what’s going on in the theater… imagine how difficult it would be to write a compelling, engaging movie while the whole time a government agent is standing over your shoulder. Whether you realize it or not, you’re writing that movie... it’s your life story.

How much different would your story be if you knew your every word and action might end up as part of some government dossier on you? How much could you embrace freedom and focus on having fun, sowing your wild oats, finding your passion, or risking failure to pursue some crazy dream if you were constantly wondering what some government bureaucrat with the power to throw you in prison or take your kids away might think of it?

And that’s the problem. Knowing our government is actively looking at emails, phone calls (or "just" meta data in some cases) as well as our online surfing and purchasing habits sends a chill down your back. With 315 million people in the country they're probably not looking at you… but they might be. Imagine you’re a journalist pursuing a story on the undue influence a company or union is having on a piece of legislation. How hard are you going to dig knowing officials could be watching? Or maybe you’re staying in a loveless marriage for the sake of your children but you have a mistress who makes you happy. Maybe you’re visiting a website of a fringe candidate who has some ideas you agree with but others you don’t. Maybe you’re unhappy with your job and are spending a lot of time on Monster.com.  Maybe you're researching erectile dysfunction.  Or perhaps you’re inventing a technology that will put a big government contractor out of business. How many of these things or others would you think twice about doing because you’d be worried about government snoops twisting your motives into some sham case or sharing your info with your family or neighbors or employer or anyone else?

We already know that government regulations touch virtually every aspect of our lives, but most of us apparently believed the fiction that we had a 4th Amendment right against unlawful searches and could therefore mitigate our exposure to government control. As the IRS scandal showed, there are instances where we have no choice but to interact with government, and the more they know about you the more force they can bring to bear on that engagement. The combination of a heavily regulated society and an all knowing government make for an oppressive mix.

Living a successful life and finding happiness are difficult enough in the best of times, when we spend our days trying to focus on making the best decisions for ourselves and for our families. How much less successful will we be if we now have to worry about what some faceless government officials think about our activities and what the consequences of their opinions will be? Is that really a recipe for a successful and fulfilling life?

Maybe your name will never land on the desk of some partisan or self-serving rouge government official’s desk. But that’s not the point. When the fear that it might is enough to cause citizens to change their behavior, the damage is already done. It’s difficult to imagine a more effective way to throttle back the freedom and creativity that made the United States the most successful and prosperous nation in the history of the world. All of this is particularly troubling today as technology is changing the world at an unprecedented rate, and it’s only getting faster. If the United States seeks to maintain its primary position in the world, it will require its citizens to be as focused on creativity and success as they can. It’s hard for them to do that as they're nervously worrying about Big Brother lurking around every computer monitor, phone line and street corner…

Barack Obama cracks the foundation of American success: Trust

One of the beauties of a free society, particularly one built on the rule of law, free markets and individual liberty is that people are often free to pursue things that are simply not possible elsewhere. Entrepreneurship in the United States thrives like it does in no other place. From restaurants that let you choose how you want your food cooked to more cable channels than your cable box can handle to the frivolity of branded apparel and Christmas antlers, the United States is a study in the science of the division of labor.

Over the course of our American history, the division of labor has grown ever more important. While 150 years ago most people would have hunted or grown their own food, built their own houses and made their own clothes, today virtually none of us do any of those things. That’s because of the division of labor. We have come to depend on one another to do what we do best. Whether as individuals or as cogs in the wheel of a corporate machine, the division of labor allows us to live far richer lives than we ever could if we had to do everything for ourselves.

A key element of that reliance on the division of labor is trust. I will only purchase food from a vendor if I am confident they are not going to poison me. I will only fly with an airline if I’m confident they are sufficiently attending to safety that the plane will not crash. I will only allow a doctor to operate on me if I trust him not to come to work drunk and kill me.

So too it is with the government of free nations. The United States is one of, if not the most free country in the world when it comes to speech – except for college campuses of course. Citizens have put their trust in the Constitution and the government it created. It is that trust that allows them to go about that making widgets or doing whatever they do. They trust and expect – perhaps foolishly – that their elected officials will at least run the government with objectivity and honesty if not with competency and efficiency. Because the citizens trust the public servants to enforce laws and do so with detachment, the citizens themselves don’t have to enforce them or scrutinize official’s every move.

A complementary element of that trust in government is the First Amendment’s protection of the Freedom of Speech. A trust that you can speak your mind and the government will not penalize you for it. Nowhere else in the world is freedom of speech protected like it is here. Try standing on a street corner in Saudi Arabia and badmouthing the Koran. Try speaking out against the government in Russia or Venezuela. Insult some protected group in Canada or Europe and you’ll likely find yourself in court or shackles.

Free speech, particularly as it relates to opposition of government officials is as American as apple pie. Despite the vile and contemptible things said about him with great regularity and impunity, George Bush was hardly the first president to feel the sting of slings and arrows – John Adams and Thomas Jefferson also withered viscous storms of opposition – but he may end up being one of the last. And America will be much worse off for it. Why? Because Barack Obama has succeeded in destroying the trust the American people have in their government.

President Obama’s use of the IRS to tilt the election playing field in his direction is repugnant to everything Americans hold dear. Americans don’t mind a spirited fight, and even expect minor examples of local irregularities, after all, you can’t expect an election where over 100 million people vote to come off without a hitch.

Barack Obama however has done something that no American can condone. As he was getting ready to have his rear end handed to him in 2010 Congressional elections, he decided to use the police power of the government to ensure that he would be victorious two years later.

Of course he was not so transparent as to send in New Black Panther party stormtroopers to “encourage” voters into pulling the Obama lever. No, instead he clandestinely used what is possibly the single most intimidating organization in the United States, the IRS. To be clear, the IRS is far from an efficient bureaucracy, but there is a difference between a dysfunctional tax code and a tax enforcement agency that is explicitly political. This is the latter: not only did his IRS delay or refuse tax exempt status for 500 tea party and conservative organizations across the country, the agency also targeted conservatives and Romney donors for intense scrutiny and public backlash.

Barack Obama won election by a total of over 6 million votes – 5 million of which came from California and New York alone. The election would have gone the other way however if just three states had changed from blue to red: Florida, Ohio and Pennsylvania. Together they cast 19.7 million votes and Barack Obama won the three by a total of 550,000 votes. Not coincidentally, the epicenter of the IRS scandal was Cincinnati Ohio.

To put the magnitude of this malfeasance in perspective, had each of those 500 organizations swayed a mere 500 citizens each in either Florida, Ohio or Pennsylvania, Barack Obama would have lost the election. But they were not able to do so because the IRS violated the public trust by becoming an extension of the Obama campaign. How many other organizations never formed because conservatives could see the writing on the wall and were not willing to jump through hoops just to be stonewalled? How much money was not donated to these organizations and others because donors feared for their livelihoods?

Whether Obama directed this travesty himself, or he merely pointed out the targets for others to harass, he is responsible for the destruction of the American trust. By turning the IRS into the arm of a police state, where one’s associations, donations, speeches and friends are scrutinized in order to stifle dissent and harm your business, he has undermined the single most important element of American society: Trust.

Americans have always looked at the actions of government with a critical and often partisan eye, but for the most part they have bought into the idea that whether it’s the Corps of Engineers, the Department of Education or even the IRS, most of government is run in a largely objective, if often inept, fashion. By using the IRS to intimidate opponents and guarantee himself a second term, Barack Obama has opened a fissure in the American body politic. One wonders how big it will grow and whether the republic can survive. If citizens begin to see the IRS as a thought police, they will begin hiding income and cheating on their taxes, rationalizing that they will be unfairly targeted regardless. And it won’t be limited to the IRS. If citizens begin to believe that the Justice Department is but the enforcement arm of whoever is in power they may begin to react differently when targeted. If citizens believe that the EPA or the Department of Energy have become political vehicles for the reward of friends or the restraint of enemies of the regime in power, they are likely to begin to disregard their rules or edicts.

At the end of the day a free society depends on the willing trust and voluntary participation of the citizens. Barack Obama has broken that trust in a big way. The question is, can the fissure be repaired so that citizens remain willing to openly engage in political debate rather than scheme under the cover of darkness with designs on upending a system they feel is no longer fair? The country survived a relative vaudvillesque version of this scandal forty years ago that ended up in a president’s resignation. Before that FDR, JFK and LBJ were experts at using the agency to pressure opponents, but their misdeeds rarely saw the light of day thanks to a servile press happy to carry their water. Barack Obama isn’t so lucky however and thanks to the Internet and a conservative press his crimes are difficult to deny, even for the blindest of followers. Whether he serves out his term or not, Barack Obama should be seen as the pernicious narcissist he is who sacrificed the public trust for his own self-aggrandizement. For anyone who has been paying attention, none of this is a surprise.
